    Existence and Freedom

    Freedom is one of the basic concepts of philosophy which can only be solved from the perspective the theory of existence.However,the problems of freedoms are never solved due to the deficiencies in the theory of existence.So a correct theory of existence must be established to solve the freedom problems.Freedom not only reflects the transcendence but also the inter-subjectivity.Transcendence again originates from existence which is possible due to its purity.According to freedom,the inter-subjectivity can not be fully realized in the real field.It can only be realized in the aesthetics.Aesthetics is the living way of freedom and freedom can only be available within it.

    Zhu Xi’s interpretation on heavenly destiny,the foundation of nature,spiritual cultivation and the relationship between heaven and secular world all emphasize the common fate facing both human beings and nature.It also signifies the different essence in these two angles,which requires each one to endow different restraints and contracts in accordance with their own fate.The purpose is only one,namely to actualize the harmony between human and nature.It also embodies the thought that human and all creatures are equal.And this thought should be the basis to advocate the harmony and unity between human and nature.

    Practical Turn and Aesthetic Logics

    As humanities,aesthetic logical starting point is human social practice,and human existence is the only aesthetics intention.Corresponding to matter exchanging level,consciousness effecting level and value evaluating level of practical structure,aesthetic logical structure should include natural object logic that is logic of conforming to law;human subject logic that is logic of conforming to purpose;logic of relation between subject and object that is logic of aesthetic inter-subject.Base on matter production,spiritual production and discourse production of practical type,aesthetic logic constitution should include image logic that is perceptual form logic;imagery logic that understands form logic;image logic that is reason form logic.Corresponding to practical mutual integration course of passive and initiative,matter and spirit,synchronic and diachronic,aesthetic logic course should include intentionality activity logic that is objectification logic;transcendence activity logic that is signifying logic;time and space activity logic that is actualization logic.Aesthetic logical power just lies in the realization of practical constructive function,transforming function and deconstructive function in aesthetic practice and artistic practice.

    Influenced by the mysterious culture of the ancient book Zhouyi,“qi” is thought as the primary existence and the highest ontology,everything in universe being the product of it.Borrowed from this saying,Chinese aesthetics holds that the movement of “yin” and “yang”,which forms “qi”,motivates all things on earth,thus inspires the writers and leads to their aesthetic creation.In this sense,“qi” is the primary force to move the writers to create aesthetically.

    In the modern society,the imbalanced climate signifies the worsening security and health of human beings in the universe environment.In order to save ourselves,we must focus on the ethics studies of climate and set up a new ethics cognitive system.The imbalanced climate resulted in the disaster and diseases which in turn aggravated the climate.The fundamental reason is the infinite activities carried out by the human beings on earth.So we must restrain the human activities and establish a harmonious coexistence between human and nature.And based on this,we should also follow the eco rules;establish the eco-interest system for the international cooperation of emission reduction.It is the premise to resume the balanced climate,resolve the disaster and reestablish the world and ecoenvironment.

    The basic way on how morality ego promotes extrovertly and practices its value lies in how to deal with and harmonize the relation between the other and I thence morality ego proves and realizes its value in both the contact relationships and social life.It was basic contacting mode between the other and I which people advocate spirits such as benevolence,loyalty-forgiveness as well putting one in the place of another to realize harmonious interpersonal relations in both Chinese traditional ethics thought and real life.Intimate relation between other and I is paid attention and talked by modern theorists such as Adam Smith's moral sentiments theory,I-You relationship theory of Feuerbach as well theory about  “the other” in vision of phenomenology which are reasonable explain about the value of relationship between other and I.External values of morality ego between the other and I in contemporary era embody such as harmonizing and respecting each other,unifying the emotion and the rationality,as it also carries forward humanitarianism universal fraternity thought.

    The natural geographical structure of Jinsha River is diversified and complicated with fragile eco-system.If human beings want to live in such a environment and seek for the economic development and eco-safety,they must follow the ways different from that of living for the maximized coexistence with nature.In history,ethnic groups of Qiangwu lived on the eco-environment with high mountains,pastures,forests and wet land.They mainly lived on the combination way of crop cultivation and animal husbandry together.And based on the accumulation of experiences and their techniques,they actualized the perfect protection of eco-environment and efficient usage of resources,thus contributing to the ecosystem along Yangzi River.

    Each ethnic group’s living environment is specified to adapt into various living environment.Meanwhile,each ethnic group has its special means of traditional living strategies.Bunu Yao people have been living on the Karst mount area for over a long period in Duan.This area with shallow and thin soils and low water resources storage capacity is selective about choosing plant’s species components.When facing the fragile ecosystem,from Bunu Yao people’s long period livelihoods,they have made their own ethnic group’s life be continued by developing and utilizing its ecological knowledge and skills which can be adapted into the nature.Thus,this ethnic group can keep developing.Meanwhile,with the ecological wisdom and technical skills,it can control rocky desertification,which can help to resolve the structural defects in the living environment and turn the worse living environment of humans’ to a valuable and changeable homeland.This fact is enough to suggest that Bulu Yao can effectively harness this catastrophic which is viewed as the “land cancer” by people.

    Social mentality exists and internalizes in every member of the society,and it is the barometer of the society.Factors influencing social mentality are complex,including social production mode,social organization structure,social ideology,cultural tradition,and factors within the subject itself,all influencing the formation and change of social mentality in different ways.A systematic exploration into it would be beneficial to change various unhealthy social mentalities and develop one that is rational,peaceful,open,and tolerant.

    Usually western religion was considered as the primary reason of homophobia,but actually homosexual activities were disciplined as non-reproductive heterosexual behavior in the religious discourse and moral practices.Modernity contributes to the gay identity while generating anti-homosexual condition,bureaucracy in modern organization and capitalist personality and spirits were contradicted with gayness.Under the pressure of cultural anomie and moral panic,the society would treat sexual deviance as symbol of social disorganization,then gay minority become the scapegoat of social illness.In the perspective of cultural interpretation,homophobia was regarded as weapons of sexism,and gay minority threats the dominated gender ideology,assaulting gay would help to strength the existing gender structure.And homophobia was believed as the social control of gender deviance.

    During the recent research about political philosophy the negative relationships between democracy and justice have seemed to be enclosed.But there are a lot of oppositions between democracy and justice,which are mainly based on the followings:democracy is not only the approach to constructing and reinforcing justice in classical political philosophy,but also plays the role of weakening and eliminating justice.From the perspective of distributive justice,the opposition between justice and democracy lies in the opposition between being naturally right and being artificially equal.Justice demands that distributing resources with social meaning should be based on interpersonal natural ranking and the meaning that  carried by resources.While democracy requires the distribution should be equally.And from the perspective of commutative justice,the opposition between justice and democracy lies in the opposition of the market and politics.And from the perspective of commutative justice,justice refers to that people participate in non-public activities under the principle of being voluntary and equal.And from the perspective of corrective justice,the opposition between justice and democracy lies in the opposition between judicial powers and popular sovereignty.What justice requires is the rule of law but not democracy.

    “Subject positions” is a core issue of identity politics.Replacing ‘subject’ with ‘subject positions’ is an important issue of the structuralist and post-structuralist philosophy.Foucault's subject positions theory provides two points:First,to reveal the mechanism of the power of discourse which constructs subject positions;Second,anti-essentialism of identity politics concept.Post-colonialism,feminism,post-Marxism and other schools practiced the two lines.Among them,the ‘disidentification’ has become a new trend of development.The article concluded that identity politics should absorb the traditional Marxist political economic thoughts,not only to pay attention to people in the discourse systems,meaning systems,but also concerned about their positions in the economic system and the state politics system.

    After more than two hundred years of development,traditional imprisonment shows a series of defects:it not only has no correction effect instead of making the criminals worse.At the same time,many serious inhuman phenomenons in the prison execution process also damaged the legitimate basis of traditional imprisonment.In the face of criticism,on the one hand,traditional imprisonment should improve and reform,promote the socialization of prison execution,and the prison community,miniaturization;on the other hand,we should try to avoid the short-term imprisonment penalty and promote community penalty.

    Internet announcement service is a method that the court informs the recipient of the content of the litigation document through the internet.Internet announcement service combines modern network technology and the traditional announcement services together.It is beneficial to protect the procedural interests of the recipient,lower the litigation cost,improve the litigation efficiency,and also accommodate the development of the network age.Presently,Internet announcement service has not been confirmed by the current law and it is an auxiliary way in the judicial practice.Therefore,in order to establish a perfect system of Internet announcement service,it is necessary to confirm the legal validity of Internet announcement service,strictly limit the applicable condition,and reasonably determine the means and periods.

    Whether there were any characters in the ancient Miao People is always a myth before we found Miao’s characters at the moment.Lately,the author had discovered more than 100 stones with inscription in the field investigation into Dankou Town of Chengbu.The characters inscripted on these stones are very similar to the ancient Miao’s characters in ancient documents and folk-balladry,to the Miao’s character widely used during the insurrectionary army of Miao People in Ming and Qing Dynasty,to some folk Miao’s characters recently used in common.The characters inscripted on stones belong to the ancient Miao people which lost for two and a half centuries.So the conception “there weren’t characters but only spoken language” should be under discuss.

    On the Construction of Subjectivity and Inter-Subjectivity of the Chinese “buguo”

    “Guo” in ancient Chinese functions as predicate meaning for the passage of time or passing of a place,which showcases its objective semantic component.“Buguo” in Chinese,which is the negation of “guo”,instantiates a relation of adverbial modifying the predicate.In actual usage,“buguo” is lexicalized and extends its meaning from “within a certain limit” to “only” which expresses speaker’s attitude and affection.When the two clauses linked by “buguo” show contradictory semantics,the meaning of contrast is entailed,thus accompanied by the process of “buguo” becoming a conjunction from adverb with the intersubjective function of regulating the hearer’s cognitive state.On the whole,from predicate to adverb and finally to the conjunction,“buguo” undergoes the construction of subjectivity and intersubjectivity.

    In Mr. Fung Yu-Lan’s books on the history of Chinese philosophy,he not only inherited but also developed and renovated Confucian classical hermeneutic thoughts and methods. It was the inheritance and development to Confucius’s “a transmitter and not a maker,believing in and loving the ancients” that brought about Fung Yu-Lan’s transformation of hermeneutic thoughts and methods from “according to speaking” to “go on speaking”. It was the inheritance and development to Mencius’s historical hermeneutic method of “know about somebody and study his background” and psychological hermeneutic method of “speculate the thoughts of others according your own ideas” that brought about Fung Yu-Lan’s method of “interpretation to ancient thoughts” with “put yourself in the other” understanding and philosophical historian opinion.

    A prominent phenomenon in the village-level democratic development is that the rich rule the village.The author thinks that the protection of the political rights of villagers belongs to electoral democracy,and protection of the villagers' economic and social rights is the task of the rule of law and democracy from the rights of villagers.This paper analyses the limitations of electoral democracy and the advantage of the rule of law democracy,puts forward the development of village-level democratic order.The paper states that it is the first rule of law and election democracy,as well as the important development strategy for the village-level democratic act.

    Identity in the private laws refers to the status of the object with the private adjustment significance in the social relations.Identity,in the process of the development of private law,gradually evolves from criteria to judge the hierarchy to a tool for justice.The identity in the modern private law should be consistent with that of the social contract.The identity objects are with diversified and open features in modern times.Individuals,communities,groups and social strata could protect their own interests based on their identity.Identity,in this way,embraces a full-fledged development.China is a traditional agricultural state and in the process of urbanization.So,the farmers are the special social class we should pay attention to,especially for the protection of their identity interests.

    Testamentary succession contains four major value paradoxes:paradox of freedom of testament and fairness,paradox of freedom of testament and efficiency,paradox of freedom of testament and order,and paradox of fairness of testament and efficiency.It has become a rational choice for the modern world to balance the value of testamentary succession and get free from such paradoxes.To comply with this trend,inheritance law in our country should be re-positioned,taking the reality of our country into consideration.Freedom of testament should be limited to a certain degree to construct a mechanism which is balanced in freedom,fairness,efficiency,and order.

    Overall social production is the unity for commodity production and eco-production.The rate of social production should also be the unity for the production speed and eco-efficiency.The rate of economic development should be based on the three factors,namely eco-cost rate,eco-wealth rate decided by the eco-production and eco-efficiency rate.The purpose and standard of production coordination is the maximization of social benefits.So we need to define the concepts of eco-production,eco-efficiency and eco-benefits scientifically.We should focus on the balanced conditions of the economic sustainable development,the restricting conditions for the imbalanced economic development,favorable factors for civilized eco-development and the balanced factors for the optimized speed of commodity production.

    Affected by scientism ideological trend,Chinese historiography in Twentieth Century embarked on a “scientific” travel.However,since 1920s,as the Xueheng School’s promoting Bobbitt’s humanism,and Thought and Times wild spreading new-humanism,the Chinese history research world tried to correct the Scientifics’ deviation under the common influence of Chinese-and-Western humanism thought trend.It gradually changed from giving consideration to science and humanity to scientific humanism,taking into account both thought and textual criticism,recommending the interaction of subject and object,advocating both intellectual pursuit and value significance,and formed a new study style.Therefore,Chinese historiography started on the new road connecting science and humanity.

    Dividing the thoughts of domestic people is the CPC’s important political theory,which includes the main task,main content and realization path.The thoughts are based on class analysis and enemies or friends analysis to clear which force can be relied on or united and which force can be isolated or against among all the classes,strata and groups.Since 1949,the thoughts have gone through various historical periods,made great achievements,and gained serious error.Historical experience shows that basic Marxism principles’ combined with China’s reality is the premise of theory and practice.And the scientific usage of class analysis and enemies or friends analysis are the key factors.How to mobilize all positive factors is the most important test.

    Mechanism of transmission is the interaction among transmission subject,media,and audience to pass,exchange,and share political information.Hardware-repairing and software-optimization are both needed to optimize the mechanism of transmission of public policy.On the one hand,political information should act as a service,and media should be properly integrated,and rational audience cultivated;on the other hand,the interactive mode of policy transmission should be re-started to construct a government-media-audience relationship,with attention paid to the effect of policy transmission.

    Legitimacy refers to the citizens’ identity with the governance of a certain state.Before the Reform and Open Policy,modern China took the Communist Ideology as the base for its legitimacy,when the media’s fundamental mission was to beautify socialism and defame capitalism.After that,the government took political performance as the base of its legitimacy,and the market economy has induced people’s desire of being rich and aroused an awareness of rights among them.Media then should shoulder a new historic mission to satisfy the citizens’ right to know,to supervise and to express.Although the legitimacy based on political performance has made a ground for the citizens’ awareness of right and offered a historic drive for the media to transform,it depends excessively on economical performance and fails to meet the citizens’ demand of political attendance,hence becomes a crucial element to prevent the media from taking on its news mission.This paper holds that Chinese government needs to make a second transformation for its legitimacy,setting up its authority based on jurisprudence,rules,procedures and system.Only by doing this can Chinese media realize their new mission authentically and meet the demand of new age.

     In the post-modern context,the relationship between symbols and realities is greatly questioned.The feminists are increasingly realizing that women are in the world of wrong representations.In “A Vindication of the Rights of Woman”,women embarked on a long and difficult road against representations.In “A Room of One’s Own”,we found the possible self-representation of women.At the same time,women are entangled in the myth of representation and anti-representation.In “The Second Sex” and “Sexual Politics”,women’s pursuit of political and cultural self-representation has been clearly stated.In view of the criticism of feminism,representation and anti-representation can be the starting point for logics.

    The Western modern author theory criticizes the notion of author as to be subjective and denies the authority of author above his works.However,this theory doesn’t get itself out of this notion entirely yet.In fact,the reason that author loses his authority to explain his own works is not the text games or reader’s carnival,but fluid subjectivity,the intersubjectivity which is melted in the process of creation.Author transcends himself by self-talk from existence for reality to existence for idealism.And this transcending leaves its trace in the works;so the works are a process of this self-talk.The works attract readers into this talk too,and the readers can also transcend themselves through the talk.

    As core concept of the heritage,integrity of folk art would be the standard measurement of the value and the rule of heritage protection.Integrity is not equal with entirety,and could not reveal all contents and forms entity,but instead just presents partial features of entirety.Also,it is not entity,but just a constructed active trend for describing objective facts,which could reflect mutability of incorporeal cultural heritage.Therefore,integrity can only embody the structural features of entirety.The construction of entirety of folk art exists in the research and demonstration of integrity.
