The Dilemma and Way out of the Protection and Development of Traditional Villages—From the Perspective of Risk Social Governance in Rural Revitalization TIAN Fangzhou Journal of Jishou University(Social Sciences Edition)    2023, 44 (5): 151-160.   DOI: 10.13438/j.cnki.jdxb.2023.05.016 Abstract （470）      PDF（pc） （790KB）（187）       Knowledge map    Save Traditional villages are the active remains of landscape genes,spatial genes and spiritual genes of Chinese traditional settlement culture,and their protection and development is an important issue in the process of promoting rural revitalization.In the context of risk social governance,traditional villages,as a special type of rural heritage,have increased the risks of endogenous social structure,cultural inheritance and industrial transformation in their protection and development,leading to the structural imbalance of rural system transformation.The dissimilation of exogenous features,the excessive tourist development,and the prominent sudden risks of disaster have made the response of rural areas to these changes abnormal.In addition,the risk of subjective administrative intervention and market intervention is enlarged,and the operation of rural protection and development is out of order.The dependence of planning path,incomplete guarantee mechanism and lack of implementation and promotion subjects in the protection and development of traditional villages are the main reasons leading to their predicament and prominent vulnerability.Combined with the strategy of rural revitalization,to resolve various risks in the process of protection and development of traditional villages,the key is to build a dynamic assessment and monitoring system and communication and participation mechanism for risk social governance,and improve the relevant laws and regulations and risk response mechanism.At the same time,the autonomous organization and planning coordination mechanism should be promoted with indigenous residents as the subjects. On the Persons Involved in the Law Case and Their Rights Protection by the Law on Supervision QIN Qianhong, LI Shihao Journal of Jishou University(Social Sciences Edition)    2023, 44 (4): 1-11.   DOI: 10.13438/j.cnki.jdxb.2023.04.001 Abstract （419）      PDF（pc） （858KB）（205）       Knowledge map    Save Under the background of deepening the reform of discipline inspection and supervision system,the Law on Supervision stipulates the special concept of persons involved in the law case.In practice,the supervisory organs and supervisors are confused about the concept of the persons involved in the case,and the Law on Supervision does not have any provision to clearly define the concept of the persons involved.Through the investigation and summary of the Law on Supervision and the Regulations on the Implementation of the Law on Supervision,the broad type characteristics of the persons involved in the normative system of the Law on Supervision can be abstracted,that is,they are involved in the crimes committed by public officials under the jurisdiction of the supervisory organs,related to the main case.Within the scope of the meaning of the persons involved in the case in a broad sense,from the point of view of the protection of human rights,the persons involved should be clearly defined as those who are related to the main case and are suspected of bribery,introduction of bribery or joint duty crimes.The provisions of the persons involved in the norms of the Law on Supervision that conflict with the above definition should be amended in the subsequent legislation in order to maintain the unity of the legal system.Under the premise of punishing corruption,in order to protect the legal rights of the persons involved in the case,we should do a good job in the understanding and application of the lenient system of pleading guilty to punishment.In the supervision procedure,the right of lawyer assistance is given to the persons involved in the case,and the legal assistance system of public lawyers is established.When applying monitoring measures to the persons involved in the case,they must strictly abide by the law and comply with the principle of proportionality.In addition,the qualified persons involved in the case should be transformed into "tainted witnesses" through the construction of the system,and exemptions should be provided for them to testify. Legal Analysis on the Issuing Contract of Land by the Villagers' Committee on Behalf of the Group Collective Economic Organization—On the Amendment of Article 65,Paragraph 1 of the Rural Collective Economic Organization Law (Draft) QU Maohui, LI Shuai Journal of Jishou University(Social Sciences Edition)    2023, 44 (4): 66-74.   DOI: 10.13438/j.cnki.jdxb.2023.04.007 Abstract （364）      PDF（pc） （769KB）（113）       Knowledge map    Save The issuance of land contract by the villagers' committee on behalf of the group collective economic organization has triggered some lawsuits about the dispute of land ownership and the validity of exchange contract for the contracted land，which has damaged the land contracting order.The current law shows that the group collective economic organization is an independent legal person,and enjoys the right to issue contract of land based on the exercise of land ownership.The villagers' group can enjoy the agent right to issue contract of land only when the daily management organization of the group collective economic organization is not sound,while the villagers' committee has no right to issue contract of land on behalf of the group collective economic organization.The key to solving the above problems is to clarify the subject of the group collective land ownership.It is suggested that the land ownership should be classified on the basis of obtaining evidence,that is,if the land has not appreciated substantially or there is a small conflict of interest,it will be resolved by collective economic organizations through consultation,and if it has appreciated substantially,it will be settled by the litigation of the parties concerned.If a substantial appreciation is possible,it will be resolved by the meeting of group collective economic organizations.Article 65 of the Rural Collective Economic Organization Law (Draft) should clarify and standardize the concepts and definitions of the rural collective economic organization，the right to issue contract and the agent right to issue contract，and specify their requirements and applicable conditions.It is necessary to distinguish between the right to issue contract of the rural collective economic organization and the agent right to issue contract of the autonomous organization for rural grassroots，and further differentiate between the agent right to issue contract of the villagers' group and the villagers' committee. Community Resilience:Structural Tension and Adaptation in Community Risk Governance ZHAO Shiyu Journal of Jishou University(Social Sciences Edition)    2023, 44 (4): 52-65.   DOI: 10.13438/j.cnki.jdxb.2023.04.006 Abstract （340）      PDF（pc） （1391KB）（145）       Knowledge map    Save In the face of the disturbance and impact of modern social risks,improving community resi-lience is an important path choice for community risk governance reform,and it is also the meaning of promoting the modernization of grass-roots governance in the new era.Different from the understanding of resilience in the Western discourse system,which advocates reducing government intervention and unilaterally emphasizes the responsibility of community and individual governance,community resilience in China's governance environment is generated by the policy resource network centered on streets and neighborhood committees and the interaction of risk governance among various stake-holders,that is,the risk resistance of community governance structure is the key to the formation of community resilience.At the current stage,Chinese communities are highly dependent on means of risk governance such as vertical administrative resource absorption,emergency backstop of neighborhood committees,and strong political mobilization,and the community governance structure has long presented internal tensions such as "resource allocation internal","subject participation differential" and "governance system mutual exclusion",which frequently lead to the governance dilemma of risk sharing failure and lack of community resilience.In view of this,it is urgent to take measures such as promoting scientific redundancy,building a collaborative governance pattern,improving the linkage disposal mechanism,and consolidating the foundation of resilience culture as a response,so as to promote the structural adjustment and functional optimization of communities under risk situations.In this way,we can effectively resolve the inherent tension in the community governance structure and systematically improve the resilience level of communities. Multi-dimensional Structure of the Quality Standard System of Modern Urban Community Governance—An Exploratory Study Based on Categorization Analysis WU Zijing Journal of Jishou University(Social Sciences Edition)    2023, 44 (4): 29-39.   DOI: 10.13438/j.cnki.jdxb.2023.04.004 Abstract （293）      PDF（pc） （953KB）（120）       Knowledge map    Save By using the exploratory research method of categorization analysis,this paper makes a coding analysis of the qualitative data of 36 communities in 10 cities in China based on in-depth interviews,which fully reveals the multi-dimensional structure and interactive mechanism of the quality standard system of modern urban community governance.It is found that the quality standard system of modern urban community governance contains three core dimensions:the core dimension of the "five-in-one" multi-actor co-governance,the core dimension of the conditional elements of the full organic combination of "hardware and software",and the core dimension of the result elements focusing on the perception and evaluation of residents' overall satisfaction.The internal structure of the core dimension of the modern urban community governance quality standard system is relatively stable,showing a three-dimensional chain conduction structure interaction relationship of "subject-condition-result".However,the different elements constituting the core dimension are not fixed arrangement and combination,but show the time-varying characteristics of highly complex nonlinear dynamic matching.This proves that the modern urban community governance quality standard system is "stable while changing". Evaluation and Promotion Strategy of Rural Human Resources Development in Ethnic Minority Areas—Based on Factors Analysis of Human Resources in Eight Provinces and Autonomous Regions with Large Ethnic Minority Populations YAN Yueping, ZHANG Xugao, LI Yalin Journal of Jishou University(Social Sciences Edition)    2023, 44 (5): 54-65.   DOI: 10.13438/j.cnki.jdxb.2023.05.007 Abstract （287）      PDF（pc） （786KB）（105）       Knowledge map    Save Based on the cross-sectional data of China's eight ethnic provinces and autonomous regions with large ethnic minority populations in 2020,an evaluation index system of human resources deve-lopment is constructed from the five aspects of population size,economic development,education and training,medical and health,and cultural environment,giving an empirical study on the development level of rural human resources in these provinces and municipals.Through data standardization processing and factor analysis,the load matrix is established,and the single factor evaluation scores of human resources quality,cost,environment and development and the comprehensive evaluation scores are calculated.The results show that the order of the comprehensive level of rural human resources deve-lopment in the eight ethnic provinces and autonomous regions is Inner Mongolia,Guangxi,Qinghai,Xinjiang,Ningxia,Guizhou,Yunnan and Tibet,from high to low.In order to improve the overall deve-lopment level of rural human resources,considering the evaluation results of individual factors in different provinces and municipals,Inner Mongolia should focus on the environmental factors of human resources development and promote the quality development of human resources;Guangxi should give full play to the quantitative advantages of human resources and transform them into quality advantages;Qinghai should speed up the construction of a modern ecological economic system in characteristic rural areas and simultaneously improve the health level of the whole people.Under the premise of speeding up development,Xinjiang should focus on upgrading technological innovation to improve the rural industrial structure;Ningxia should focus on education and training and vigorously enhance the level of governance;Guizhou should speed up high-tech economy and empower the development of rural human resources;Yunnan should further promote private economy and border economy and raise the disposable income level of rural residents;and Tibet should do a good job in the basic work of human resources development and increase investment in education,medical care and infrastructure construction. The Inherent Logical Transformation of Althusser's Critical Theory of Ideology LU Bindian Journal of Jishou University(Social Sciences Edition)    2023, 44 (5): 130-140.   DOI: 10.13438/j.cnki.jdxb.2023.05.014 Abstract （269）      PDF（pc） （806KB）（113）       Knowledge map    Save Althusser's critical theory of ideology takes up an important position in the ideological pedigree of Marxism abroad,which affects the theoretical construction of post-Althusserism,and the change of its inherent logic has triggered discussions from related scholars.Based on the analysis of On Reproduction and Three Notes on Discourse Theory,some clues are found hidden in the transformation of the internal logic of Althusser's critical theory of ideology.First,before the May Storm,Althusser emphasized the epistemological fracture between science and ideology and regarded ideology as a structural and mirror existence;after that,he paid more attention to the political function of ideology,emphasizing the analysis of "ideology in general",especially the national ideology.Second,Althusser's critical theory of ideology was once indebted to the psychoanalytic theories of Freud and Lacan,focusing on the analysis of the unconscious and the application of the mirror theory.Later,Althusser gradually rose to the analysis of the materiality and practicality of ideology,emphasizing the quasi-behaviorism and material basis of ideology.Third,Althusser's discourse theory clarified the general theory of historical materialism and other local theories,distinguished four discourse forms and carried out pioneering and critical academic exploration,which established the spiritual purport of Althusser School.This is a transitional theory,which lays the philosophical groundwork for the subsequent theory of ideological arousal.Therefore,there are obvious differences between Althusser's thoughts in different periods,but they are not completely broken,rather they are a unity of continuity and discontinuity.Althusser's thoughts in the early and late periods are bridged,which not only adhere to the scientific and structural interpretation of ideology,but also combine ideology with social existence,psychoanalysis and historical materialism.They break through the static interpretation of ideology,enhance the explanatory effectiveness of the theory,and produce a new materialistic understanding paradigm. Xi Jinping Thought on ecological civilization scientifically reveals the inherent law of harmony between man and nature, profoundly expounds the dialectical relationship between the replacement of civilization and the rise and fall of ecology. This indicates that the Party and the government have reached a new height in their understanding of the regularity of the construction of ecological civilization and provides a fundamental basis for the construction of ecological civilization in the new era. In the journey of Chinese-style modernization, to promote the construction of ecological civilization at a high level, we should take Xi Jinping Thought on ecological civilization as the guide to theory and action. Administrative intelligent decision-making is characterized by intelligent concentration, decision-making initiative, self-adaptation and distribution, which can make proactive decisions and respond to complex decisions rapidly. Highly adaptive and able to expand decision-making scenarios continuously, it is an important part of building a collaborative and efficient digital government system. The system of digital government service industry in China, centered on administrative intelligent decision-making, can be divided into core industry, supporting industry, ancillary industry and derivative industry, all of which have entered a growing period of industrial development, forming an intelligent technology ecosystem and further evolving a new model of administrative intelligent decision-making. However, problems are also obvious in the development, such as insufficient investment in basic innovation, prominent structural contradiction between supply and demand, incomplete industrial chain, insufficient policy implementation, strict data collection, lack of high-end technical personnel, and so on. In order to promote the healthy, orderly and sustainable development of digital government service industry in China, we need to solve the problems from the aspects of top-level design, guidance mechanism, industrial environment, regulatory system and legal constraints, and so on. However, it has the historical limitations of upholding class rule. The Communist Party of China (CPC) practices the “two integrations” (integrations of the basic tenets of Marxism with China’s specific realities and fine traditional culture), adheres to the basic viewpoint that “the masses are the creators of history”, attaches importance to the historical role of the masses, relies on the people, protects civil rights, and tries every effort to improve people’s livelihood. Thus, it establishes the fundamental purpose of “serving the people wholeheartedly” and makes a new Marxist interpretation of the traditional “people-oriented” thought. While inheriting the rational core values of the “people-oriented” thought, it has realized its innovative development and creative transformation: the traditional thought of “people-orientation” is an expedient tool of the ruling class, yet the fundamental purpose of the CPC is based on the highly unified interests and will of the Party and the people; the “people-oriented” thought depends on the moral self-discipline of the ruling class, yet the implementation of CPC’s fundamental purpose is determined by its class attribute; the “people-oriented” thought is pragmatic as a tool, yet the fundamental purpose of CPC is the truth proved by the new democratic revolution. Comparing the two, the fundamental purpose of CPC is to transcend the thought of “people-orientation”, from a “boat-water” relationship to “fish-water” relationship. Putting the people above all else, practicing the “two integrations”, CPC’s fundamental purpose has got new connotation in the new era, with “serving the people wholeheartedly” at a new height. Where Should the Embodied Cognition Go?— Also on the Origin,Visions and Concerns of the Second-generation Cognitive Science CHEN Wei Journal of Jishou University(Social Sciences Edition)    2024, 45 (1): 73-84.   DOI: 10.13438/j.cnki.jdxb.2024.01.007 Abstract （162）      PDF（pc） （869KB）（159）       Knowledge map    Save The second-generation cognitive science,represented by embodied cognition,challenges the"physical symbol system hypothesis" and its derived computational representation.Its core view is to explain that all of our perceptual,cognitive,and motor abilities are constitutively dependent on aspects of the agent's body.Based on the above consensus,the 4E cognition has drawn a vision of the second-generation cognitive science by highlighting the role of the perceptual-motor system in the cognitive process,cognitive affordance,and the concept of embodiment based on perceptual experience.However,the spell of neuron reductionism,the reproducibility of empirical evidence,the lack of explanations and the dissolution of the predictive processing on the cognitive "sandwich model" all warn of the methodological pitfalls of the second-generation cognitive science.Due to the lack of explanation,the reliability and validity of embodied cognitive effect are often questioned.From the epistemological origin,the resolution of the cognitive "sandwich model" by predictive processing transcends the historical deadlock in the debate between the two generations of cognitive science on physical and mental issues.Many difficulties encountered by embodied cognition at present warn that there are still hidden worries in methodology in the second generation of cognitive science,and the future debate on the purpose,method,conceptual basis and motivation of embodied cognition will continue to provide new inspiration for the exchange,confrontation and blending of multi-disciplines within cognitive science.
