Property right is the guarantee of free will.Man exists by the possession of materials.Individual freedom and independent personality cannot exist without property right.Equal freedom does not mean average possession of wealth, and labor is the fundamental way to possess wealth. The appearance of private proprietary right is not only a sign of social progress, but also the realistic foundation to form the common proprietary rights.

Two Different Explanations about the Distribution of Justice——Arguments between Rawls and Nozick
    CUI Yan-Qiang, TU Xing-Yong
    Journal of Jishou University(Social Sciences)    2006, 27 (1): 7-11.
    Abstract2587)      PDF(pc) (209KB)(1186)       Save
Regarding the distribution of justice, though both Rawls and Nozick approved the importance of justice,Rawls more emphasized equality.Through the hypothesis of “original position” and with the aid of the two principles of justice,he relieved the “ignorance veil” so that the least beneficiary could be compensated and equality obtained.Nozicks thought that the most important question was not equality, but the sacred right. He refuted Rawls’ theory of justice distribution through “minimal state” and with the aid of “principle of justice maintenance”.Though these two arguments differed greatly, they all concerned about the priority of freedom and equality in the economic domain. The two views revealed the contradiction between freedom and equality in western society, and they were significant in our construction of a harmonious society.

The concept of totality ran through the whole of Lukacs’s thought, which was interpreted as the unity of life and essence as well as a cultural form of ancient Greece in his early book The Theory of Novel. However, totality was only expressed in the form of art in modern society. In his History and Class Consciousness, totality referred to the nature of capitalism recognized by proletariat,a unity of proletariat consciousness and existence, and it could only be expressed by the class-consciousness of proletariat. It was until the appearance of Aesthetic Features that totality was interpreted as the historical necessity of social existence, and finally became a Marxism ontology concept.

During the Anti-Japanese War (1938-1945),Chinese people’s national consciousness began to strengthen with the intensifying national crisis. From the point of self –defense of a nation, many Chinese intellectuals changed their attitude toward national tradition. They thought that if a nation was to survive, its symbol, the national tradition, should be kept, thus they arrived a conclusion to make new by going back to tradition. However, they met a dilemma which had puzzled Chinese since the late period of Qing dynasty. In other words,if they changed the pragmatic factors in Chinese tradition, the new ethos would be non-tradition,or was even against tradition;and if they followed the pragmatic ones, there would be no transition in Chinese ethos. In this sense, the modernization of Chinese ethos was not successful until the end of the Anti-Japanese War.

Only the theory of contribution is the truth among the theories of social justice;all other theories are wrong. However, none of them is completely wrong, for whatever wrong theory it is and no matter how wrong it is,it adapts certain principle in social justice that belongs to the theory of contribution or is deducted from it.Firstly, the equalism has the most principles on social justice,e.g.the basic rights are completely equal, the non-basic rights are equal in portion, and the  equal in chance and consequence (equal in politics and economy).Though these principles in the eyes of the equalists are not all deducted from the theory of contribution, they can be deducted from the theory of contribution and thus they belong to the category of contribution theory.Secondly, the theory of needs has the fewest principle;the only one principle in it is to distribute human right according to the basic needs. However, the nature of this principle is to distribute human rights according to the contribution to society, thus it also belongs to the category of the contribution theory.Lastly, the right principles of social justice by the theory of free justice are two equal principles,i.e.the complete equal in basic right and the non-basic rights are equal in portion;they belong to the category of contribution theory, either. Therefore, the theory of contribution includes all the right principles of social justice and is the truth of social justice.

According to international law or international practice, all the fishery resources of territorial waters belong to the country inshore only.Since the end of the 19th century and the beginning of the 20th century, the problem of protecting the fishery right of China had become increasing serious, the exclusive fishery right of China was violated.During the Republic of China period Japan was rampant in fishing in the waters of China illegally. In order to carry out their illegal fishing plan, the Japanese government and personal organizations carried on massive investigations to Chinese fishery resources. They fished illegally in the waters of China illegally all-around,from the northeast coast to the coasts of Fujian and Guangdong provinces. There were Japanese fishing vessels everywhere in China.Compare with other big powers,Japan had its own characteristics in fishing in China illegally.Japanese fishing in China lasted more than half a century and had the extremely profound influence. It was a factor holding back the development of China’s fishery. It also destroyed the integrity of Chinese sovereignty over territorial waters. But on the other hand,it was an objective factor accelerating the constitution of the system of territorial waters in China.
