The Construction of Safe Harbor Rules in China's Anti-monopoly Law LI Guohai, WANG Yining Journal of Jishou University(Social Sciences Edition)    2022, 43 (2): 60-71.   DOI: 10.13438/j.cnki.jdxb.2022.02.008 Abstract （1441）      PDF（pc） （795KB）（507）       Knowledge map    Save The safe harbor rule of anti-monopoly law has been practiced for a long time in countries such as the United States and the European Union,and the fundamental motivation is the conflict between the universal applicability of anti-monopoly law and the complexity of its regulatory object.Legislators and law enforcers need to introduce appropriate tools to balance them.There are not only close relations but also significant differences between the safe harbor rules and the reasonable principle,exemption system and application exclusion system in the anti-monopoly law.In terms of content,because the abuse of market dominant position is harmful to market competition,the safe harbor rules of anti-monopoly law are not applicable to this kind of behavior;in terms of applicable conditions,market share elements are taken as positive elements,and the application of seriously restricting market competition behavior is excluded.The safe harbor rule in anti-monopoly law can be divided into two operating modes:presumption of legality and presumption of exemption.There are some doubts in Chinese academic circles about the introduction of safe harbor rules into anti-monopoly law,but these questions can be resolved.The rule has been preliminarily explored in the anti-monopoly practice of our country,which has accumulated preliminary experience for the construction of the rule.It is necessary for our country to introduce safe harbor rules into legislation.The following points should be grasped in the quotation:excluding the application of horizontal monopoly agreement,resale price maintenance agreement and abuse of market dominant position,adopting the safe harbor standard with market share standard as the main standard and alternative standard as supplement,and adhering to the principle of the combination of difference and unity and the coordination of stability and flexibility. The Influence of Environmental Information Disclosure Quality on Green Innovation ZHU Peng, GUO Wenfeng Journal of Jishou University(Social Sciences Edition)    2022, 43 (6): 92-101.   DOI: 10.13438/j.cnki.jdxb.2022.06.010 Abstract （1007）      PDF（pc） （745KB）（466）       Knowledge map    Save Taking Shanghai and Shenzhen A-share listed companies with heavy pollution from 2010 to 2019 as research samples,this paper makes an empirical analysis on the green innovation effect of environmental information disclosure quality,and tests the intermediary role from the perspective of financing constraints and agency costs.The results show that there is a positive correlation between the quality of environmental information disclosure and the level of green innovation in heavily polluting enterprises.From the perspective of influence mechanism,financing constraints and agency costs play an intermediary role in the relationship between the quality of environmental information disclosure and green innovation.Specifically,the improvement of the quality of environmental information disclosure can effectively reduce the negative impact of financing constraints and agency costs on green innovation,thus it promotes green innovation.Further study finds that environmental information disclosure quality in promoting green innovation is only established in state-owned enterprises,large-scale enterprises and the eastern region,which provides empirical evidence to formulate environmental information disclosure policies,promote green innovation and the green transformation of enterprises. Derived Risks and Their Transmission in Internet Public Opinion Reversal:Type Division and Relief Strategy ZHU Guowei Journal of Jishou University(Social Sciences Edition)    2023, 44 (3): 99-111.   DOI: 10.13438/j.cnki.jdxb.2023.03.009 Abstract （753）      PDF（pc） （1207KB）（453）       Knowledge map    Save The information control behavior in internet public opinion reversal can change the evolutionary direction of public opinion events by influencing the interpretation and attitude of information audiences,during the process of which new social risks are stimulated.According to the inductive combing of 50 widely discussed cases of internet public opinion reversal that occurred in 2016-2022,it is found that information control behaviors in internet public opinion reversal on the one hand take information content and cognitive framework as the control objects,and on the other hand social risks derived from information control behaviors may be transmitted to political and non-political domains.According to the results of the analysis,internet public opinion reversal can be classified into "leveraging type","uncontrolled type","reef type",and "crisis type",with "information control mode" and "risk transmission direction" as the core dimension division.After analyzing the four types,it is found that the evolution of the internet public opinion reverse is accompanied by the derivation,transmission and accumulation of social risks,forming a dual structure of "surface public opinion + deep social risks",which not only causes serious harm to social order and political stability,but also triggers the inertia of people's political distrust and becomes an important cause of mass incidents.Therefore,changing the separation of internet public opinion control and risk management and strengthening the risk management process in internet public opinion is the key to preventing and resolving the derivative social risks and their transmission in the process of internet public opinion reversal.On the one hand,the public sector should further strengthen the regulation and standardization of information dissemination and enhance its own information dissemination influence and competitiveness to dissolve information control behaviors;on the other hand,the public sector should create a flexible and rigid public opinion field and actively respond to the demands of groups in public opinion events to ease the derivation and transmission of risk energy. Paradoxes of Agricultural Policy Implementation by Grassroots Governments and Countermeasures：Based on the Analysis of the "Ambiguity-Conflict" Model HUANG Jianhong Journal of Jishou University(Social Sciences Edition)    2022, 43 (2): 116-124.   DOI: 10.13438/j.cnki.jdxb.2022.02.013 Abstract （2081）      PDF（pc） （779KB）（369）       Knowledge map    Save When the rural revitalization strategy is fully implemented,various agricultural policies have been implemented in rural areas.However,there is a huge contrast between the policy text system and the actual implementation level,resulting in a paradox of policy implementation.On the one hand,the implementation of various agricultural policies by the grass-roots government is in full swing;on the other hand,farmers and other grass-roots policy participants are calm and even indifferent to the implementation of agricultural policies.Based on the analysis of the "Ambiguity -Conflict" model as the analytical framework,this paper analyzes the process of agricultural policy implementation in Q Town,W County,and discusses the administrative implementation under the hierarchical structure,the political implementation under the political tournament,the experimental implementation under positive inertia and the symbolic implementation under sub-paralysis.It is found that in the top-down implementation path with low fuzziness,the grass-roots government generally completes the policy objectives by establishing a model of typical implementation and fostering elites' alternative implementation because of hierarchical pressure and performance evaluation;while in the highly fuzzy bottom-up implementation path,the grass-roots policy target groups finally deal with negative implementation and mechanical symbolic implementation through various formalism because of the lack of sense of participation and initiative.The paper further explains the root of the paradox of agricultural policy implementation,and on this basis,puts forward the ways to improve grass-roots government agricultural policy implementation,such as resource integration,balance of interests,farmers' participation,pluralistic linkage and so on.
