司法大数据与司法公正的实现

摘要/Abstract

摘要：司法大数据是司法活动与大数据科技的结合及其在司法领域的积极运用。司法大数据以裁判结果为载体，融合了立法与案例的多种信息与数据资源，为法官审判案件提供了可依据的数据支持，可帮助法官形成对案件的认知和判断，对司法公正具有积极的“正功能”。但司法大数据在提升审判质效的同时也会因为数据科技的缺陷给司法公正带来“负功能”。因此，应重视数据标准和规范的建设，提升司法大数据使用的合理性和安全性，消除“数据陷阱”，让大数据切实助力司法公正的实现。

Abstract: Judicial big data is the combination of judicial activities and big data technology and its active.Judicial big data,taking the result of the judgment as its carrier,integrating a variety of information and data resources of legislation and cases,provides reliable data support for the judges to form their cognition and judgment of cases.In spite of its positive impact on judicial justice,it also produces negative effect on judicial justice due to the limit of data technology.Therefore,we should attach importance to the construction of data standards and norms,improve the rationality and security in the use of judicial data,and eliminate data traps so that big data helps realize judicial justice.
