Abstract: Since the implementation of the Labor Contract Law,there have been drastic arguments about the unfixed-term labor contract.The author of this paper holds that it is difficult for the Labor Contract Law to regulate avoidance due to the deviation of value orientation of the law from the conditions of the country in transition.To reduce avoidance of the law,the legal restriction on unfixed-term labor contract should be appropriately loosened,the legal system of unfixed-term labor contract perfected,and the liability system of avoidance improved.
