On the New Theory of Crime Concepts

Abstract:  In the spectrum of criminal law and criminology,little research has been done on the crime concept,which not only affects the academic dialogue among different disciplines,but also constrains the discipline development in a way.The concept of crime is a concrete manifestation of the values;thus it is not feasible to pursue its interdisciplinary and unified concept.Through the investigation of the crime concept,the proper relations between criminal law and criminology can be concluded as follows:in the field of criminology,crime is a social fact with value property and it is reflected in the measurement of the behavior and its consequences;and in the field of criminal law,crime is a normative fact,which serves as the value judgment on the crime as a social fact and is reflected in the disposal of criminal.
