Labor Standard System and Public Interest Litigation

摘要:劳动基准是法律规定的用人单位必须保障劳动者享有的最低劳动权利、劳动条件和劳动待遇,具有强烈的公益属性。我国对于劳动基准实施艰难的现状表明,通过传统诉讼已不能有效地解决劳动基准纠纷,而劳动基准与公益诉讼之间具有高度的契合性,这呼唤着将公益诉讼程序导入到劳动基准纠纷的解决过程。我们应当构建完善的劳动基准公益诉讼理论与制度,从而维护不特定多数劳动者的劳动基准权利。

Abstract: The labor standard system is the lowest standard about working conditions and labor rights prescribed by law,which has a strong sense of public interest.The situation that our country encountered many difficulties implementing the labor standard system conveys that only by traditional litigation can’t we resolve labor standard disputes effectively.What 's more,the labor standard system corresponds to the public interest litigation in a high degree,which calls us to introduce labor public interest litigation system in the field  where employers violet the lowest standard of the labor protection.We should establish the improved labor standard public interest litigation system to protect the minimum labor rights defined by law,so as to protect the basic rights of laborers.
