摘要/Abstract

摘要：非讼案件和诉讼案件是民事案件的基本分类。长期以来，我国民事诉讼法学界缺乏对非讼案件的专门研究，不能适应市场经济的发展和社会结构的变化。通过对非讼案件的本质和范围进行域外考察，有利于为我国对非讼案件的探讨提供借鉴,深化非讼案件和非讼程序的研究,以充分发挥民事非讼程序在预防纠纷和稳定社会秩序中的积极作用，促进司法解决民事案件功能的整体发挥。

Abstract: Non-litigation case and litigation case are the two basic classifications of civil case.However,for quite a long time in China,no sufficient study has been given to non-litigation case in the field of civil procedure law to meet the demand of market economy and the changing social structure.Thus foreign investigation on the nature and range of non-litigation case will provide reference for us to deepen the study of litigation case and non-litigation procedure,so that non-litigation procedure may play a positive role in preventing disputes and stabilizing social order.
