碎片化传播下微短剧版权治理的结构性困境与系统破局

Structural Dilemmas and Systemic Solutions in Copyright Governance of Micro-dramas under Fragmented Communication

摘要:当前,微短剧在内容创作、传播宣发、运营投放过程中面临多元侵权形态,涵盖剧本抄袭、生成式人工智能工具化侵权、二次搬运等问题。微短剧面临的多元侵权形态,本质上是传统著作权制度与数字内容生产范式间系统性错位的体现。这一错位集中表现为四重矛盾:法律制度演进滞后于技术迭代、版权边界模糊与权利主体意识弱化相互强化、侵权隐蔽性与维权成本间形成结构性失衡,以及平台在责任认定与执行层面存在制度性缺位。应对上述挑战,需构建以“制度—技术—平台—生态”为核心的多维治理框架:在制度层面推动法律更新与监管强化,技术层面建立基于智能识别与溯源技术的版权基础设施,平台层面明确主体责任并建立政企协同机制,生态层面依托公共服务平台与行业自律机制协同支撑。该治理框架不仅为微短剧版权治理提供系统解决方案,也为数字时代内容产业版权治理范式转型提供了实践路径。

Abstract: Micro-dramas face multifaceted copyright infringement throughout their lifecycle,spanning creation,distribution,and operation.These violations—including script plagiarism,generative AI-enabled infringement,and unauthorized content repurposing—reflect fundamental misalignments between traditional copyright frameworks and digital production paradigms.Four structural contradictions underlie this systemic dissonance:legal frameworks lag behind technological evolution;blurred copyright boundaries exacerbate weak rights consciousness;infringement concealment creates cost-prohibitive enforcement;and platforms demonstrate institutional accountability gaps.Addressing these challenges necessitates a multidimensional governance framework integrating institutional,technological,platform,and ecological dimensions.Institutional reforms should accelerate legal adaptation and regulatory enhancement;technological solutions require intelligent identification and traceability infrastructure;platform governance demands clear accountability mechanisms and public-private coordination;ecological development depends on professional services and industry self-regulation.This integrated approach not only resolves micro-drama copyright dilemmas but also advances governance paradigm transformation for digital creative industries.
