摘要/Abstract

摘要：现代性是思考国家刑罚权基础的一个理论视角。现代中国关于国家刑罚权基础问题是建立在马克思主义经典作家的国家理论之上的。从这一视角来看，权力是国家刑罚权的真正支撑点。在福柯的后现代视角中，任何主体都成了权力机制的对象。而以权力为基础的刑罚理论对犯罪人来说是不道德的。所以，刑罚理论的支点应转移到犯罪人的自由意志上来，并且要综合报复主义和功利主义的刑罚理论。

Abstract: Modernity is one of the theoretical perspectives to consider a nation’s punishment power.The foundation of nation’s punishment power in contemporary China is based on the theory of the Marxism authors.From this view,power is the real standpoint of a nation’s punishment power.In Foucault’s postmodern perspective,any subject will be the object of power mechanism.However,the theory of criminal punishment based on power is immoral to the criminals.So the standpoint to the theory of criminal punishment must be transferred to criminal’s free will and theories of criminal punishment shall be based on utilitarianism and retributionism.
