摘要/Abstract

摘要：民族习惯法与国家制定法之间产生冲突的实质和原因在于: 普遍正义与特殊正义的冲突; 移植法律与本地民族特点的冲突; 现代法律文化与传统法律文化的冲突。促使二者融合, 推进西部民族地区法制建设的途径是: 开展调查;合理使用民族自治区域法律变通权;确立习惯法有限适用原则; 实施社区实验示范引导制订乡规民约。

关键词： 西部乡村, 少数民族, 习惯法, 法制建设

Abstract: The essence and the cause of conflict between the ethnic cus tomary law and nat ional law lies in the confl ict between universal justice and speci fic justice , the confl ict between: transplanting law and charac teristics of local ethnic, and the conflict between the culture of modern law and the cul ture of traditional law. The way to make ethniccus tomary law congruent with national law and promote legal cons truc t ion in the west minori ty etynic dis trict is to inves -tigating the real li fe of rural area,make use of the inflexibi li ty right of the law in the wes t ethnic autonomous dis trict ,es tablish the principle of using ethnic customary law in a rational way and set experimental model ub working out the rule and regulat ion in the west rural area .
