公务人员检举内部贪腐行为的困境与超越

Dilemma of Impeachment for Corruption of Public Servants and Its Countermeasures

摘要:贪腐行为具有隐秘性、狡猾性和高度的犯罪黑数等特质,唯有通过知情的公务人员对其进行检举,才可能真正有效反腐。但欲检举贪腐的公务人员面临外部社会评价和内部行政伦理的困境,外部社会认为检举是告密,内部行政伦理要求公务人员对组织忠诚;以及检举后检举人可能面对更多的风险或危险。因此,我们必须从培育新的检举文化、革新行政伦理、加强对检举人的保护以及建立检举人激励机制方面作出努力。

关键词: 行政检举, 行政伦理, 激励机制

Abstract: The acts of corruption are secretive,cunning and in a position of highly criminal dark figure,the impeachment by the informed public servants might be the only really effective way of anti-corruption.However,the public servants who are willing to expose corruption are faced with both the external social evaluation and internal administrative ethics dilemma.External society considers impeachment is whistle-blowing,internal administrative ethics require public servants to be loyal to the organization.They are likely to confront more risks or even dangerous after impeachment.Therefore,we must foster new corruption impeachment culture,innovate the administrative ethics,strengthen the protection measures and make endeavor in building prosecutors incentive mechanism.
