Abstract: After more than two hundred years of development,traditional imprisonment shows a series of defects:it not only has no correction effect instead of making the criminals worse.At the same time,many serious inhuman phenomenons in the prison execution process also damaged the legitimate basis of traditional imprisonment.In the face of criticism,on the one hand,traditional imprisonment should improve and reform,promote the socialization of prison execution,and the prison community,miniaturization;on the other hand,we should try to avoid the short-term imprisonment penalty and promote community penalty.
