摘要/Abstract

摘要：神判是原始父系制形成后家庭私有制经济发展条件下的必然产物。它利用原始风俗习惯所信奉的神的权威与巫术相结合的方式来裁决氏族或部落内部的民事纠纷，是一种在原始习惯下的不成文的法律手段。

Abstract: The God of Judgment is an inevitable product of private family economy after the primitive patrilineal system was formed.It settled the civil disputes within the clan or tribe with the God's authority and witchcraft,and was a means of unwritten law under the primitive custom.
