摘要/Abstract

摘要：从法律冲突存在的空间上分析，少数民族婚姻习惯法与国家制定的婚姻法之间的冲突，具有区际法律冲突的属性；从法律适用的对象上分析，少数民族婚姻习惯法与国家制定的婚姻习惯法之间的冲突，具有人际法律冲突的属性；从法律冲突的法域及其对主体权利义务确定的方式上分析，少数民族婚姻习惯法与国家制定的婚姻法之间的冲突，具有“二级法律冲突”的属性。

关键词： 民族婚姻习惯法, 国家制定法, 冲突属性

Abstract: The conflicts between minority marriage custon and national marriage law have the attribute of law conflict of interregional,analyzing from the space where law conflict exists.Analyzing from the objects which law apply to,the conflicts between minority marriage custom and national marriage law have the attribute of law conflict of interpersonal.Analyzing from the ways which are used to make sure which kind law should be apply to and subjects' right and duty when the laws conflict,the conflicts between minority marriage custom and national marriage law have the attribute of “secondary conflict of laws”.
