摘要:自1995年《担保法》颁行以来,我国就开始实行抵押权登记制度。这一制度在我国维护社会经济秩序,保障交易安全以及提高交易效率的过程中起了很大作用,但这一制度尚不完备。本文试图通过一起未经登记的抵押合同纠纷,结合国际上抵押权登记的立法体例分析讨论现行的中国关于抵押权登记的效力问题,希望能以此促进抵押权登记制度以及物权立法的完善。

Abstract: Since the guarantee law of the People's Republic of China came into effect in 1995, Our country has begun to put into effect the regulations of the registration in mortgage. Although the regulations maintain social econormic order,ensure the safety of trade and raise the efficiency of the trade, it still has the imperfections. Starting from a case of non-registrated mortgage contract,combining with the international legislative rules on the registration in mortgage,the article tries to discuss the problem of registration in mortgage in China nowadays.With a view to helping improve the regulation, especially the perfection of the property law in China.
