摘要/Abstract

摘要：票据丧失对失票人利益影响重大。为保护其他法律主体的利益，兼顾票据的正常流通，在实施票据公示催告制度的过程中，应注意以下几个问题：1.公示催告的期间计算问题；2.权利申报人主张票据权利的时间盲点问题；3.公示催告公告的制作问题；4.在公告期内和公告期外善意取得票据的法律效果不同的问题；5.公示催告期间票据的正常流通问题。

Abstract: Loss of bill greatly affect interest of owner of the lost bill. Interest of other legal subject requires protection and normal negotiation of bill need to
be taken into consideration,thus the institution of bill public summons for exhortation is becoming more and more important.Many problems,including term-calculation of public summons;producing of publication;normal negotiation of period bill; legal effect of innocent obtainment of bill in and out of the term; and time scotoma of obligee’s claiming right of bill etc,are all waiting for further perfecting.
