The Dual Carbon Goals and the Improvement of Food Legal System in China

Agriculture is the fundamental industry of national economy,and food is the foundation of agriculture.Facing the natural defects of weak industries,legal means is necessary to develop a climate-smart food industry.To achieve this,we should innovate the legislative concept of food law,take carbon emission reduction,carbon operation balance and carbon absorption optimization as the target elements of dual carbon goals,ensuring national food security on the basis of a sound ecological environment.At the same time,we should strengthen the allocation and reorganization of rights,promote the legalization of environmental rights and food rights,and achieve the organic unity of environmental rights and food rights.Based on national conditions and combined with the Food Security Law,we should consolidate general provisions such as legislative concepts,rights allocation,and governance models.Three major institutional systems should be established.The first is the carbon emission reduction system,which emphasizes source disposal,focuses on greenhouse gas emission control and reduction,and promotes food-saving and loss-reduction.The second is the carbon operation balance system.Carbon operation is in the intermediate link.Carbon monitoring and carbon traceability should be strengthened,and carbon market transactions should be actively promoted.The third is the carbon absorption optimization system,which is suitable for the end management,therefore we should speed up carbon sequestration and increase sink,promote carbon recycling,and effectively fulfill carbon responsibilities.In general,responding to the dual carbon goals and improving the food legal system is an important component of the rule of law for dual carbon and an essential part of national food security.
