The Construction of the Right of Algorithm Interpretation and the Path of Legal Guarantee:Taking the Construction of Social Credit System as the Scene

Abstract

Abstract: The algorithmic decision is increasingly used in the construction of social credit system.However,the objective fairness of credit information and the rights and interests of credit subjects are facing greater challenges.As a new right,the right of algorithm interpretation can meet the dual needs of regulating algorithm decision and protecting the rights and interests of credit subjects,while the ambiguity of the applicable standard and the blurred stages and boundaries have become major obstacles to the right of algorithm interpretation.Therefore,we should provide legal guarantee for the right of algorithm interpretation,clarify its legal orientation and applicable standards,improve the specific design of pre-and post-interpretation of algorithm decision,and establish with a supervision mechanism for the subject of algorithm interpretation.
