The Three Function of Patent System

Abstract

Abstract: The function of the patent system in promoting technological innovation and economic and social development is widely seen as an ultimate goal.It is also the key function of the patent system.However,the constitution of the functions of the patent system has always been overlooked.Under innovation economics,the basic resource of economic and social development derives from technology diffusion—which is the main function of the patent disclosure under the article 26 of Patent Act.For the purpose of patent disclosure,we shall teach the common technical personnel how to carry out the invention (teaching function),manifest itself what the inventor has created (possession function),and disseminate the information of technology and right (information diffusion function),and thus cause patents to accomplish that goal—adding to the public’s “general store of knowledge”.To realize the function of the patent system,we should resort to patent documentation.
