Abstract: As a new type of property,digital heritage has characteristics significantly different from other properties.Possessing the attributes of matter,property,and heritage,digital heritage requires the realization of inheritance.However,digital inheritance now is facing with the dual dilemma of law and reality.On the legal level,there are deficiencies in the property law to give definable affirmation to digital heritage;and in reality,the relationship between multiple rights and obligations relating to inheritance subject is complicated,and the various scopes of protection relating to inheritance object are hard to define,and the conflicts of interest in different trades are also hard to coordinate.So,revising inheritance law,or issuing judicial interpretation,or issuing cases as guideline should be the specific ways to realize digital inheritance.
