高校校内学生申诉制度的法社会学研究——以北京市高校为研究样本

On the Law Sociology of the Appeal System for Students in Higher EducationalInstitutions(HEIs)——A Case Study in Beijing

摘要:高校校内学生申诉制度于2005年正式实施,教育部的规范性文件对其具有的规范功能予以初步阐述,即化解矛盾、维护权利及维持秩序。各高校根据教育部要求纷纷设立该项制度,但其规范功能在实践中的表现各有不同,体现为其功能是否实现、实现的程度以及该制度是否还发挥其他功能等方面。本文以北京市高校为研究样本,对上述实践情况予以描述、分析和总结,认为国家对高校进行行政规制的方式与程度、高校自治的程度等是影响高校校内学生申诉制度功能的重要因素。

Abstract: The appeal system for students in HEIs has been implemented since 2005.Its regulatory functions which have been defined initially by the regulatory documents issued by the Ministry of Education are to resolve conflicts,protect the rights and interests and maintain order.Required by Ministry of Education,plenty of HEIs have established this system with different effect in implementation however.This paper,based on the research sample of the HEIs in Beijing,has depicted,analyzed and concluded the specific implementation effects.It is concluded that the government’s policies towards the administration and autonomy of HEIs play a vital role in the appeal system.
