摘要：法学作为一门艺术，并不是一个比喻，而是另一个视角的白描。拟制就是不可推翻的虚构，在作为法学主要研究对象的法律和政治现象中，广泛存在着拟制。这些拟制不是作为认知实验才有意义，而是其本身就具有实践意义和终极价值。它不仅有助于人们得出适当的判断而且也有助于人们采取必要的行动。

Abstract: The law is a kind of art,which is not a figure of speech but a simple description from another point.The fiction is the makeup which cannot be repudiated.There full of the fictions of the law and political phenomena which are regarded as the main research objects of the law.It is the need of the reality and the consideration from the value that is its real foundation.
