论我国少数民族原始宗教的法制管理

摘要/Abstract

摘要：我国传统宗教事务管理一贯采取诱导多元宗教信仰制衡的作法，让不同宗教在相互制衡中消解其负面效应，这是我国传统宗教事务管理的宝贵经验。同时，儒家思想的“严华夷之分”又导致对原始宗教的冷漠歧视，将其排除在宗教信仰规范管理之外，致使对原始宗教的法制管理长期脱控，这是今天我国宗教事务管理应吸取的教训。原始宗教有其自身的特点，它不应当隐蔽在一神教初始阶段的阴影之下，应加大对原始宗教的调查和研究，从宪法、民法、刑法及社会治安管理诸层面强化对原始宗教的法制管理，使之成为我国宗教事务管理部门正常的工作任务之一。

Abstract: Influenced by the Confucian idea,the traditional religion management in our country has been conducted in a multi-religion way to reduce the negative aspects of the different religions.Meanwhile,the strict religious distinction of “ China and Foreign” of the Confucian idea has lead to the indifference and discrimination to the primitive religion,excluding it from the religion management.It is important to have a deep understanding of the primitive religion,determine its position in religion,and put it under the legality management so that it could become one of the normal tasks for the religion management department in our country.
