人权公约与我国宪法人权规定之完善

摘要/Abstract

摘要：我国政府先后签署《经济、社会和文化权利国际公约》和《公民权利和政治权利国际公约》，意味着我国政府对公约中人权条款的认可。两个人权公约与我国宪法人权规定之间，既有一致性，也有差异性。比较两个人权公约与我国现行宪法人权规定的异同，规范和完善我国现行宪法中的人权规定体系，对于完善我国人权法律保障制度具有决定性的意义和基础性的作用。

Abstract: The signatures of “The International Convention of Economic, Social and Cultural Rights” and “The International Convention of Civil and Political Rights" mean the approval of our government to the human rights clauses. Between the two conventions and our human rights prescribed by the constitution, there are both uniformity and differences.A comparison of the similarities and differences show that standardizing the current system of our living constitution is of decisive and fundamental significance of the perfection to the safeguard system of our human rights.
